Following Kanye’s erratic behavior, an inside source unveiled Kim Kardashian’s decision to file for divorce and end her longstanding relationship with Kanye West.

However, even though the couple has not yet signed the papers officially, many have begun to wonder how a custody battle for their four children will pan out.

Back in 2014, before their marriage, Kim and Kanye did sign a prenup however; it did not have an indicative clause about a child custody agreement. Even many years later the parents did not decide to add a clause after their children were born and this mistake might make them run into a few hiccups down the road.

An inside source close to Kim also revealed details about a possible battle to VH1 and they were quoted saying, “He’s making all kinds of deals right now that are very high stakes, and Kim’s nervous.”

“Kim’s worried sick about Kanye’s current situation, which has incurred millions in legal fees already, and is only getting more expensive and complicated. [Kim] wants to protect herself, and for all her faults nobody could blame her.”

It is not uncommon for couples to leave details regarding their children out of their prenups because that is an aspect that requires even more extensive deliberation. Not only that, many a times there is no way for a couple to know just how many kids they might end up having in the future, and so such decisions cannot be made in writing most of the times.

One major issue regarding the child custody agreement, which might end up favoring Kim, could be that no judge would ever grant full custody of children to a parent who is not mentally fit and judging by Kanye’s history with mental illness, as well as his recent erratic behavior, his chances of winning such a battle are miniscule.
