Sean “Diddy” Combs is asking for a major legal win, as his attorneys push for his release and challenge how his case was handled in court.
The appeal was heard on Thursday, April 9, before three federal judges.
Attorneys Alexandra Shapiro and Nicole Westmoreland told the court that Combs’ trial was unfair and that his conviction should not stand under the First Amendment.
They also challenged the basis of his conviction under the Mann Act, which bans transporting people across state lines for prostitution related activity.
His lawyers argued the recordings were not criminal conduct, but staged, consensual content made for private viewing.
"Freak-offs and hotel nights were highly choreographed sexual performances involving the use of costumes, role play, and staged lighting, which were filmed so Combs and his girlfriends could watch this amateur pornography later," his lawyers argued.
Prosecutors pushed back strongly, calling the claim “meritless” and saying Combs is “entirely differently situated from adult film distributors”.
However, Combs was not present in court during the appeal hearing.
Following that, he was convicted in July 2025 on transport for prostitution charges after his September 2024 arrest on racketeering and sex trafficking claims, but cleared of the most serious charges.
Later, he was sentenced in October 2025, sent to Fort Dix prison, and his release date was revised to April 25, 2028 after rehab.
