Post Malone is not giving up his only child that easily as the custody battle with ex-fiancée heats up.
The singer has filed a new court filing to prevent the mother of his three-year-old daughter from permanently taking her to California.
The motion asserts that the child should stay in Utah because she has lived in the state for most of her life.
The documents were filed in a Los Angeles court on May 19 in response to the custody petition by Malone’s ex, Hee Sung “Jamie” Park.
According to the filing, the couple lived in Utah until their split back in November, after which Park relocated to LA and her former partner agreed for their kid to switch states every two weeks.
However, the mother filed for primary custody last month after enrolling the kid in multiple extra-curricular activities to prove that she belongs in California.
Malone accuses Park of “intentionally misleading” the judges by not disclosing that his daughter attended daycare, music classes and swimming lessons in Utah.
The motion is scheduled to be heard by Los Angeles County Superior Court in late July.
Post Malone has not publicly disclosed the name of his three-year-old child but she was referred to as “DDP” in court documents to maintain her anonymity.
