A Florida woman is suing Kraft Heinz Foods Company for its Velveeta microwaveable mac and cheese after claiming that the product only takes three and a half minutes to prepare.
The woman, Amanda Ramirez, proposed a $5 million class action lawsuit against the company that its Velveeta Shells & Cheese takes longer to prepare than advertised.
The lawsuit alleges that the microwavable single-serve cups of mac and cheese is advertised to be ready in three and a half minutes which is "false and misleading".
Ramirez’s lawyers argue that the product does not account for additional steps to prepare the product: removing the lid and sauce pouch, adding water, microwaving, and stirring.
These steps therefore makes it impossible for the mac and cheese to be ready in the stated time.
Ramirez "is like many consumers who seek to stretch their money as far as possible when buying groceries," the complaint states.
But because of the time claim, she "paid more for the Product than she would have paid and would not have purchased it or paid less had she known the truth."
The company released a statement calling the lawsuit "frivolous".
"We are aware of this frivolous lawsuit and will strongly defend against the allegations in the complaint," a Kraft Heinz Foods Company spokesperson told CNN.
